The application for the appointment Of a receiver could be made either by petition or motion, but it was usually made by motion; the application was based upon the case made by the bill, or upon facts occurring after the bill had been filed, and could be made at any stage Of the proceedings, before or after appearance or answer of the de fendant, or interlocutory decree, according to the urgency and exigency of the case.

In receivership cases, it was usual to insert in the bill a special prayer for the appointment of a receiver.
